In these Terms, “the Company”, “we”, “us” and “our” refer to Unison Colour Pastels Limited. “The Customer”, “you” and “your” refer to the purchaser of our goods.

2. Application of These Terms

2.1 These Terms & Conditions apply to all purchases made by consumers through our website, whether within the United Kingdom or internationally.

2.2 By placing an order with us through our website, you agree to be bound by these Terms, which override any terms proposed by you unless expressly agreed in writing by a director of Unison Colour Pastels Limited.

3. Consumer Sales Only

3.1 These Terms & Conditions apply to consumers only and do not apply to trade customers.

3.2 By placing an order with us, you confirm that you are not acting in the course of business and are purchasing as a consumer only.

3.3 These Terms apply to all quotations, orders and contracts for the sale of goods unless expressly agreed otherwise in writing by us.

4. Products

4.1 All products are handmade soft pastels. Due to the nature of handmade manufacture, minor variations in colour, size, shape or finish may occur and shall not constitute a defect.

4.2 Product descriptions, images and colour representations in catalogues, on our website or in other materials are provided for guidance only. We cannot guarantee exact colour matching due to production methods and screen or print variations.

4.3 All products are subject to availability. We reserve the right to discontinue or change our products without notice.

4.4 Our products are supplied with the appropriate warning labels and safety information. You must read and follow all warnings and instructions supplied with the products.

5. Ordering Process

5.1 Orders are placed via our website by adding products to your basket and completing the checkout process.

5.2 Your orders constitute an offer to purchase. A contract is formed only when we send you an order confirmation email.

5.3 We reserve the right to refuse or cancel an order, including where:

  • the product is unavailable;
  • there is an obvious pricing error; or
  • we reasonably suspect misuse or abuse of the ordering system.

6. Prices and Payment

6.1 All prices are shown in GBP (£) and include VAT where applicable.

6.2 Delivery charges are shown separately during checkout.

6.3 Payment must be made in full at the time of ordering using the payment methods shown on our website.

6.4 We will not dispatch goods until payment has been received in full.

7. Delivery

7.1 We will deliver to locations stated on our website.

7.2 Estimated delivery times are provided for guidance only and are not guaranteed.

7.3 We shall not be liable for delays caused by carriers, customs authorities or events beyond our reasonable control

7.4 Risk in the products passes to you when they are delivered to your address.

7.5 Ownership of the products passes to you once we have received payment in full.

8. Restrictions on Onwards Sales

8.1 The Customer shall not list or sell our goods or products on any third-party online marketplace or platform (including, without limitation, Amazon, eBay or Etsy).

8.2 The Customer acknowledges that any breach of the restriction of onward sale may cause irreparable harm to the Company for which damages alone may be an inadequate remedy, and agrees that the Company shall be entitled to seek injunctive or equitable relief in addition to any other remedies available.

9. Consumer Right to cancel (Distance Selling)

9.1 You have the right to cancel your order within 14 days of receiving the goods, without giving any reason.

9.2 To exercise the right to cancel, you must inform us clearly (by email to sales@unisoncolour.com) before the cancellation period expires.

9.3 You must return the goods to us within 14 days of cancellation.

9.4 You are responsible for return postage costs unless the goods are faulty or incorrect.

9.5 We may reduce your refund if the goods have been opened (where applicable), the goods have been damaged, or the value of the goods has been diminished by handling beyond what is necessary to establish their nature and characteristics.

10. Refunds

10.1 We will refund you within 14 days of receiving the returned goods.

10.2 Refunds will be made using the same payment method you used for the purchase.

11. Faulty or Incorrect Goods

11.1 Under the Consumer Rights Act 2015, products must be as described, of satisfactory quality and fit for purpose.

11.2 If your goods are faulty or incorrect, you are entitled to a repair, replacement or refund in accordance with your statutory rights.

11.3 If there is a problem with your order, you must contact us as soon as possible, by email to sales@unisoncolour.com.

12. Product Warnings and Proper Use

12.1 Our products may contain pigments or materials that are hazardous if misused.

12.2 Products are intended for artistic use only and must not be used for any other reason.

12.3 You must:

  • follow all warnings and instructions provided with the products;
  • keep products out of reach of children unless specifically stated otherwise; and
  • not ingest or misuse the product.

12.4 We are not responsible for harm or damage caused by failure to follow supplied warnings or instructions.

13. Limitation of Liability

13.1 Nothing in the Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.

13.2 Subject to clause 13.1, we are not liable for:

  • losses not caused by our breach;
  • business losses (as we only sell to you as a consumer); and
  • misuse of products contrary to instructions or warnings.

14. Intellectual Property

14.1 All content on our website, including text, images, logos and product descriptions is owned by or licensed to Unison Colour Pastels Limited.

14.2 You may not copy, reproduce or use any content without our prior written consent.

15. Personal Data

We process personal data in accordance with our Privacy Policy, available on our website.

16. Complaints

If you have a complaint, please contact us (by email at sales@unisoncolour.com) and we will try to resolve it promptly.

17. Governing Law and Jurisdiction

17.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

17.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Amendments

We reserve the right to amend these Terms at any time. The version in force at the time of order acceptance shall apply.

Colour Chart Guidance

We believe the colours in our web based colour chart are a faithful representation of our pastel range. But with any colours portrayed on the internet, there’s a whole heap of variables which mean that what you see, may not be what we see. That said, there’s some things that can be done to mitigate some of the variance.

Mobile phone and tablet screens tend to be pretty good for colour, so they’re always worth using, when viewing our colour chart.

We hate to say it, but cheaper computer displays, including laptops, can be rather hit and miss, in both colour and contrast, so they might not reveal the depth of the colour, as well as the true tone.

If you’re really keen on getting your computer up to speed on colour representation, you can use a calibration device to reach your display's fullest potential.

With all that said, if you think we’re way off the mark with any of the colours then, by all means let us know, and we’ll give it another shot.
